T&C’s

  1. The following Terms and Conditions will form the basis of the contract that will exist between us when we have taken your booking.
  2. The contract between us is governed by English Law and any dispute will be dealt with under the exclusive jurisdiction of the courts of England and Wales.
  3. You will receive an email confirmation with full details of the lessons you have booked.
  4. We are pleased to welcome new clients mid-way through a term provided there is a suitable class available.  Term fees will be payable pro rata.
  5. All bookings are accepted on a ‘first come first served’ basis and where we cannot provide a suitable class we operate a waiting list.  When a suitable space becomes available we will contact you to let you know.
  6. All swimming courses are booked and paid for as a term.  It is not possible to pay for lessons individually with the exception of one to one lessons.
  7. If you cannot attend a lesson for any reason, Aqua Dragons is unable to offer a make-up lesson, credit or refund.  Lessons therefore are not transferable.  Should we have space in a suitable class then Aqua Dragons is happy to offer this place at its discretion.
  8. Any cancellations due to force majeure, terrorism, war and pandemics will not be refundable.
  9. Should we not be able to provide a lesson for any reason (excluding force majeure, terrorism, war and pandemics) we will offer you a make-up lesson where possible or a credit towards the following term.  If Aqua Dragons cannot offer a make-up lesson then you will be entitled to a full refund to the value of the cancelled lesson(s).  If your lesson is cancelled part way through we will endeavour to make this time up during the term however if this is not possible you will receive a credit on a pro-rata basis.  Credits will only be issued to those in attendance.
  10. Aqua Dragons is under no obligation to issue a refund for lessons missed due to adverse weather when the venue and environment is safe and accessible.  We are unable to offer a refund due to adverse weather conditions that may prevent you from attending a class.
  11. Occasionally lessons do run into half-term breaks, school holidays and bank holidays.  Term dates can be found on the website and are included in your email confirmation.
  12. All swimming instructors working with Aqua Dragons hold a relevant SEQ/STA certificate.
  13. All classes are restricted to a maximum of 6 participants.  Very rarely one of our instructors maybe unable to teach, should this happen we will endeavour to provide a teacher to cover however if this is not possible classes may have to be combined as a ‘one off’.
  14. Aqua Dragons reserves the right to change the teacher, class size and times; these changes would arise from exceptional circumstances and we would make every effort to mitigate the impact of these changes.
  15. Should you have any complaints or comments please contact Stephanie Reid so that we may resolve the issue as soon as possible.
  16. Current customers will have the first option to book a place for the following term.
  17. Aqua Dragons will email current customers when rebooking for the following term is due and a date by which to make payment to confirm your place.  Your place is guaranteed once payment has been received.  If payments are not received by the date stated, Aqua Dragons reserves the right to offer that place to another customer and your place maybe lost.
  18. If the payment date is missed but the customer wishes to continue swimming with Aqua Dragons then we ask that they contact us via the website, email or phone as soon as possible.  Unfortunately we cannot guarantee a place once this deadline has passed.  We will of course endeavour to offer a suitable class if possible.
  19. When rebooking Aqua Dragons will aim to keep your lesson at the same time or as close as possible to your current time.  If we need to move your class time we will contact you prior to doing so.
  20. Preferred method of payment is transfer by BACS.  Bank transfers should include the swimmers name in order to identify payment.
  21. Cash payments are not encouraged due to the risk of money being lost on poolside.
  22. If a refund (either partial or full) is owed then Aqua Dragons can deduct it from the amount due for the following term as a credit.  Alternatively a refund can be sent directly by bank transfer or in the form of a cheque.
  23. Aqua Dragons reserves the right to change or withdraw the discounts, special offers and trials at any time.
  24. Should clients need to change lessons or premises mid-way through the term, Aqua Dragons will make every effort to accommodate but cannot guarantee a place due to restrictions on class sizes.  Aqua Dragons is under no obligation to issue a refund if it cannot find an alternative course.
  25. Aqua Dragons will offer a full refund if the client chooses to cancel the whole course two weeks prior to the start of the term.  To make a cancellation please email Stephanie Reid.
  26. For the avoidance of doubt if cancellations are not made two weeks prior to the start of the term Aqua Dragons cannot offer a refund.  In such circumstances we will endeavour to fill the space.  If a new customer can be found to fill the space Aqua Dragons will offer a refund at its discretion.
  27. Parents/guardians are to remain on the premises during the lesson.  In the unlikely event of a medical emergency, building evacuation or other situation it is important that parents/guardians are present.
  28. Aqua Dragons is responsible for pupils during their swimming lesson and parents/guardians are responsible at all other times. The swimming lesson begins when the swimming teacher has called the pupils name and has taken charge of them and ends when the whistle is blown and pupils are instructed to return to their parents.  Pupils are told to go directly to their parent or guardian; we therefore ask that parents/guardians are ready to collect their child(ren) at the end of the lesson.
  29. Aqua Dragons does not accept liability for injury to a swimmer or those in attendance with the swimmer which may be caused by any defect at the swimming pool or venue.  Any claim arising from such an incident must be addressed directly with the proprietors of the pool premises.
  30. Prams and buggies should not be taken into the changing rooms or onto poolside. Outdoor shoes should be removed or plastic overshoes worn before entering poolside.
  31. Siblings and friends of children attending the lessons should be supervised at all times by a responsible adult.
  32. Parents/guardians are welcome on poolside to watch their child’s lesson.  Please be aware that noise is kept to a minimum and any children watching are supervised by a responsible adult at all times.
  33. A copy of Aqua Dragons Public Liability Insurance Policy is available on request.
  34. Photography: To ensure the safety and welfare of the children in our lessons we ask that no photos or video are taken of children during the lessons; photographic equipment includes mobile phones, cameras and other recording devices.  Should you wish to take a photo or film your child swimming please speak to the teacher in charge on poolside.

 

Privacy Statement May 2018

What information do we ask for?

We will ask for your name, contact number(s), email, postal address, your child(s) name(s), their date of birth/age and any medical conditions.  This information will be collected either over the phone, via email or our booking form.

Why?

We may need to contact you to offer your child lessons should you be on our waiting list or perhaps speak to you regarding your child’s lessons during the term.

We send out emails to update our clients during the term and for re booking purposes.

We also send emails about our holiday courses.

To provide you/your child with safe, appropriate swimming lessons it is important for us to know their name, age and any medical conditions.

Lawful Basis for processing your details

We have considered the lawful basis for processing personal data and believe we have a Legitimate Interest in the information collected.  This essentially means we’re not collecting the personal information we ask for from you for the sake of it; we feel the information is necessary to book you/your child/children onto our swimming lessons.

How long do we keep your information?

We will delete your personal data as soon as it is no longer required.  We will of course delete any personal information we hold should you request us to do so.

Reasonable steps have been taken to keep your personal information safe; our emails are password protected and we use firewall software.

Your rights

You can ask us to delete any personal information we hold at any time

You can ask to see the information we hold at any time

You can change/update any of your personal information at any time; indeed it is helpful for us to have your current contact details and of course any changes in medical status

WE WILL NOT ABUSE YOUR TRUST.

WE WILL NOT UNDER ANY CIRCUMSTANCES SHARE YOUR PERSONAL INFORMATION WITH ANY OTHER PARTY.
